Costume in progress

pepsi

I love how they want to blame a secretary! Do you know how many times you get notified in a case of different settings? MANY times. Can't believe Pepsi dropped the ball like this and fed the secretary to the wolves.

Price to PepsiCo for Not Being in Court: $1.26 Billion

What's the cost of not showing up to court? For PepsiCo Inc., it's a $1.26 billion default judgment. A Wisconsin state court socked the company with the monster award in a case alleging that PepsiCo stole the idea to bottle and sell purified water from two Wisconsin men.

Now the company is scrambling to salvage the situation. The damages award was handed down on Sept. 30. PepsiCo filed motions to vacate the order and dismiss the claims on Oct. 13, saying it wasn't even aware of the lawsuit until Oct. 6.

The litigation began in April when Charles Joyce and James Voigt sued the soft drink maker and two of its distributors, alleging they had misappropriated trade secrets from confidential discussions the plaintiffs had with the distributors in 1981 about selling purified water. The information was illicitly passed to PepsiCo, which used it to develop and sell Aquafina bottled water, the plaintiffs allege in the case filed in the Circuit Court of Jefferson County before Judge Jacqueline Erwin.

In court documents, PepsiCo argues it was improperly served with the Wisconsin lawsuit in North Carolina, but also asks the court to excuse the corporate bureaucracy that buried a legal document for weeks. While plaintiffs say they served the lawsuit in June on PepsiCo's registered agent in North Carolina, where the company is incorporated, PepsiCo says its law department at the company's Purchase, N.Y.-based headquarters was not notified until September.

"The bottom line is there was a defect in the process for us, but also for" the plaintiffs, said PepsiCo spokesman Joe Jacuzzi, who called the case "highly dubious."

Robert Roth, a lawyer for PepsiCo at Menomonee, Wis.-based Niebler, Pyzyk, Roth & Carrig, couldn't be reached for comment. Another lawyer for PepsiCo, Dean Panos, a partner at Chicago-based Jenner & Block, declined to comment.

In court papers, PepsiCo claims it first received a legal document related to the case from the North Carolina agent on Sept. 15 when a copy of a co-defendant's letter was forwarded to Deputy General Counsel Tom Tamoney in PepsiCo's law department. Tamoney's secretary, Kathy Henry, put the letter aside and didn't tell anyone about it because she was "so busy preparing for a board meeting," PepsiCo said in its Oct. 13 motion to vacate.

When Henry received a forwarded copy of the plaintiff's motion for default judgment on Oct. 5, she sent that to Yvonne Mazza, a legal assistant for Aquafina matters. Remembering that she still had the other document, Henry passed it to Mazza too. The next day Mazza sent the documents to David Wexler, a department attorney, and he "immediately" called the agent to get a copy of the complaint.

Lawyers for PepsiCo distributors Wis-Pak Inc. and Carolina Canners Inc. made court appearances in June and July. PepsiCo was at a loss to explain why it hadn't heard about the case from them. "It's just another unfortunate thing that didn't come together," Jacuzzi said.

In seeking to dismiss the case, PepsiCo argues that the statute of limitations should preclude the lawsuit, brought 15 years after the company started selling Aquafina and more than two decades after the alleged confidential talks. Moreover, "the $1.26 billion judgment that has been entered is unprecedented in size and justice requires that PepsiCo have a chance to defend itself," the company said.

The lead plaintiffs lawyer, David Van Dyke of Chicago-based Cassiday Schade, said Wisconsin courts have been "pretty clear that they don't like" vacating default judgments. "There is a possibly that a judge may say we're going to litigate the damages aspect of it," Van Dyke said.

A hearing is scheduled for Nov. 6.

Tucker's Party

Tucker's party was A LOT of fun. It was a lot of work setting up and taking down but it was totally worth it. Thanks to Victor and Michelle and Melody who stayed after and help take down! I have a lot of photos to upload into shutterfly for a slide show but here are some snippits from the party. I still have more to download of the fire belly dancer and our balloon artist and Tucker blowing out the candles on his cake, but my battery died during the download process so those will come later.

CAT scan update on Kerri

Cut and paste from Dana:

Kerri is back from the CAT scan. There are no blood clots in the lungs. This is good, but it also does not give us a really good answer as to what is going on. The doctor thinks that she may have a secondary infection on top of the pneumonia. He is starting her on an additional antibiotic that covers several strains of bacteria until the cultures come back from the bronchoscopy. At that time, they will switch her to an specific antibiotic for the infection that is growing. The doctor is also starting her on some steroids (which is a bit controversial) to hopefully help with some of the inflammatory process in her lungs caused by all of the pneumonia. They are also re-starting the nitrous oxide. The next step, if these things do not work, would be to put her back on the oscillator, which they put her on when she was admitted a week ago. The doctor states that he is throwing everything at Kerri that he can.  Because H1N1 is so new in the US, the doctors are looking at New Zeland and Australia for medical therapies that have been successful, as they have already been thru their flu season. In the end, the doctor did say that she is not as bad as she was when she came to the hospital a week ago, but her case is still VERY critical. Thats all I have for now. Love, Dana.

Latest on Kerri

It's a bad day. Here's a cut and paste from Dana, Kerri's sister:

It's a pretty tense day today. For the last 2 days, Kerri's O2 sats have been going down at various times, with no really good explanation. It takes a long time for her levels to resolve and it makes for a pretty tense situation, especially when you're already feeling so helpless. So, today, they have done a bonchoscopy on her to check for possible secondary infections, though the results were normal. The doctor states that the lungs look good. At 1:30, they are taking her down for a CAT scan to look for possible blood clots in the lungs. Apparently, this is a common finding in patients with H1N1. Actually, they just rolled her down, vent, IV poles, bed, and all. The scan should only take about 5 minutes and then we will just have to wait for the radiologist to read the films. We will update when we have more answers. PLEASE, PLEASE continue to pray. We are all pretty emotional today. Love to everyone. Love, Dana

info on kerri

I finally got some info that makes me feel sooooooo much better. I was thinking that Kerri was getting a brain scan but Dana (Kerri's sister) set me straight. They were testing Kerri's brain FUNCTION, and that is done by reducing her sedation to see how she tolerates it. She tolerated it some but then they put her back on. I'm sure this will be done several times until Kerri can adjust or until they are able to remove her tube. What brings tears (OF JOY) to my eyes is that Kerri calmed down to Adrian's voice when he spoke to her. Kerri always talked about how she loved Adrian's "sexy" accent, but never knew it would come in handy one day. ;-) I'm thinking tonight I will be able to get some sleep now that I understand a little better. A brain scan vs a brain function = 2 totally different things.

Tucker's party

Tomorrow is Tucker's party! Can't believe my baby is turning 3!! Well, he's 2 until Tuesday, but still. I am not mentally ready for this party. We've had so much going on and then this past week my brain has been a pile of mush. I can't concentrate on anything. 24/7 my mind is on Kerri.  Thank God for my mom! I gave her a list and $ and she went and got the food, paint (for the race track), party favors and ordered the balloons for me. The weather is suppose to be full of sunshine and in the 60's. Hopefully there aren't a lot of mosquitos from all the recent rain. Not sure how many people will be there. This flu season has everyone on edge.

Kerri update!

Kerri is rockin' today. She's improving and getting better day by day!!! Just so everyone knows, they have now set up a webpage for everyone to check out updates and posts from Kerri's family, and where you can leave a message there too. Here's the link: http://www.caringbridge.org/visit/kerripeech

Here's a cut and paste from the facebook update page today:

Good Morning. The doctor told us that the fine line that we are walking with Kerri's case, we are no longer walking so there is some breathing room. That being said, she is still in critical condition, he says. They have lowered the amount of oxygen they are giving her via the vent to 55%. Her oxygen saturation levels are remaining in the mid to upper 90's. They have stopped the major antibiotic they were giving her for the septic shock, as her labs have been in an acceptable range. They have decreased her sedation levels somewhat, so at times if you say her name, her eyelids flutter. We were told to watch her to make sure that her hands don't move, because they do not want her pulling at her tubes. They attempted to feed her, but she is not tolerating that at this point, though they did hear some bowel sounds. My brother-in-law, David, was just in the room with her when they were suctioning out her mouth and he said that she did not seem to enjoy that becacuse her brain wave monitor went pretty high. We are glad to know that Kerri's fighting spirit is still in there. All in all, more good news for today. Again, thanks to everyone for your continued support. Also, we have received all the personal emails, texts, and voice messages and hope that everyone understands that we cannot possibly respond to each and every one, so we are trying to do our best to update everyone here. Thanks so much for the continuous prayers and support you are all sending our way. We love you all. Love, Dana and Jenny

Updates on Kerri

I know there are quite a few visitors here at Blogging with the Blevins that are following Kerri's updates closely. I wanted to cut and paste the updates from Kerri's family from Jenny's (Kerri's sister) facebook page. That's how they are trying to relay most info out b/c they are overwhelmed with text, emails, phone calls, etc.

This is Dana.....I wanted to be responsible for at least 1 update. We are all very encouraged today. The doctor says that Kerri's condition is finally trending upward. He says that she is much improved since Saturday, and even yesterday. They just took her off of the oscillator and put her on a conventional ventilator. This is a huge step. Her sats went down to the mid 80's for a short time and then went back up to the mid 90's. She has a low temperature as a result of the septic shock. The doctor said that is to be expected. They plan to slowly start feeding her thru her oral gastric tube. Her swelling has gone down. The doctor made a joke and said that Kerri was "aesthetically damaged". We all cracked up and were relieved that he felt that the situation had improved enough to make a joke. He said that, in no way is Kerri out of the woods. She is still sick enough to be in the ICU and that she still has a very long road ahead of her. Adrian's mom finally arrived from Dubai last night, so we are very relieved that she made it. We cannot tell all of you how much everyone's support, prayers, calls, and emails have meant to our entire family. We have no doubt at all that it is because of the awesome power of prayer that Kerri is alive and thriving. Please continue to pray. As far as visitors go, while we appreciate all of the offers we cannot allow anyone other than our family to come at this time. She is still in very critical condition and we will re-explore visitation possibly when she moves out of the ICU. In the meantime, if you want to send a card to Kerri, she is at Good Samaritan Hospital in Lafayette, CO. She is in ICU room #9. To pass the time, Jenny, our Aunt Jeanie, and I are making a book for Kerri filled with, not only all of the medical details from day to day, but also funny little things that happen while we are all sitting here at the hospital. We will include all of your emails, cards, and words of encouragement in this book as well. Our hope is that, once Kerri is finally ready, she will want to know what has happened during this entire "ordeal". If nothing else, it is therapy for all of us. Again, thank you so much for the support and love being sent our way. We love all of you and are blessed to have you all in our lives. Love, Dana and Jenny.

I just want to take a moment to thank everyone for your prayers and good wishes for Kerri a d Adrian and our families. We want to give God the glory for Kerri's progress and we know it is by His grace that she has come this far. It is with th...e help of all of your prayers and love that we can go on and stay strong for Kerri and Adrian. So thank you all, and please continue to remember us all in your prayers. Judy Drenth

Pics of Kerri

I sit here patiently at work trying to keep busy so I don't stress out why I haven't had an update on Kerri in 22 hours. I'm praying that no news is good news. I'm so tempted to call the hospital but I'm trying not to. I'm sure by noon I will know something. I have to. Anyway, came across these 2 photos of Kerri and her sisters I wanted to show.

flu shots and h1n1 shots

Why is it that the govnt and media are pushing SO HARD for the h1n1 vaccination, yet, not everyone can get them? I don't get it. They are going on this marketing frenzy of scaring everyone but they are not allowing everyone access to the vaccination! I just called to schedule Shelby and Tucker for their flu shots and finally made the decision that I would go ahead and get them the h1n1 vaccination, and now I'm told that Shelby can't get the vaccination b/c she's too old. She has to be under 3 according to the government mandate! WTH??? This really infuriates me!

Miley Cyrus Concert

Thursday night I took Shelby to see the Miley Cyrus concert in San Antonio. We had a lot of fun even with our seats being nearly last row. Shelby didn't get up and dance, but she was quite winded from climbing up all the steps after getting over being sick. She did sing from her seat the whole time. Miley sings quite well live. You could tell she was getting over the flu (read that on her twitter before she deleted it). She didn't talk much and she didn't dance with her dancers all that much. She sang and head banged the whole time. She crawled up on this motorcycle and was wisked around in mid air as she sang I Love Rock and Roll. DEFINTELY NOT A DISNEY SHOW. There was nothing colorful. Mainly she wore black and white clothing and it was all a bit....short. She did a lot of squating moves and like I said early, head banging. Miley is defintely trying to get away from Hannah Montana. This was alllll Miley. But it was good and we had a lot of fun!

Kerri Drenth Peech Update - Please keep the prayers coming!!!

From Jenny, Kerri's sister - The past 36 hours have been a roller coaster ride, to say the least. My sister, Kerri, has impressed her family, friends and medical staff beyond belief! Many times we have thought we were going to lose her. And honestly, there is a strong possibility that could still happen. However, I am happy to say, as of this moment, that Kerri is continuuing to fight. She has taken a turn for the better. In the words of her doctor, "I won't say that she's turned a complete 180 degrees, but 175." And we will gladly take it! Kerri has numerous things going on with her. In the first place, she is pregnant and we think this has had something to do with how she got sick so quickly. With her immune system being low because of the pregnancy, she has been more susceptible to getting sick and not being able to fight off the sickness as easily if she were not pregnant. As of right now, we do not know how the baby is doing. She is 13 weeks right now and the doctors have made Kerri their main concern (understandably so). The doctors have no idea how all of this will affect the baby. We're praying that God will protect that little baby with all His might. Other than that, Kerri has a SEVERE case of pneumonia in both lungs, a collapsed lung, H1N1, septic shock, malnourshiment and pockets of air that are sitting all around Kerri's chest. At any moment, any one of these things could cause Kerri to take a turn for the worse. She continues to breathe with the help of a ventilator and nitrous oxide. They have lowered the oxygen to 60% and Kerri will begin the task of breathing on her own as they lower the oxygen. With the help of a machine called an oscillator, her lung is being inflated. I don't know when they'll take her off that machine. The hope right now is that as Kerri makes progress, they will slowly ween her off of the machines. They continue to keep Kerri "paralyzed" to save up all her energy and so the oxygen can circulate more efficiently through her body. Again, as she makes progress, they will ween her off the paralytics and she will eventually, "wake up." The longer she is on the paralytics, the more her body will atrophy. When she does wake up, she will have a long road of physical therapy ahead of her. In our family, there are 3 girls. Out of all 3 of us, Kerri has always been the one that never gets sick. I guess she was saving up her sick days for this. My other sister (Dana) and I were talking about how Kerri has always wanted to run a marathon. We were laughing because she has barely run a day in her life. But, as we said goodnight to Kerri last night, we told her that she was finally running her marathon and she was doing a great job! She is fighting for her life! The doctors and nurses are "wildly amazed" that she made it past Saturday night. Each hour is a nail biter! One minute we're celebrating, the next we're choking on our tears. We have faith that our Great Physician will pull Kerri and that little baby through. And wouldn't it be such a tesatment to His glory??!!
Here are some specific things you can pray for:
1. That Kerri would continue to fight. That her body would stay strong and that we'd continue to see progress, big or small.
2. Protect that little baby. That the baby would continue to grow and stay healthy.
3. Pray for Adrian, Kerri's husband. He is not resting at all! He needs to stay healthy and strong. 4. Keep all of us around Kerri healthy. We're wearing masks and washing our hands like crazy. But we need to remain healthy to support Kerri and Adrian.
5. Pray that Hadley, Kerri and Adrian's 2 year old daughter, doesn't feel neglected during this time. Again, thank you to all of you who are praying! We feel your support and encouragment.
If you have a facebook account, I am putting all updates there. You can add me as a friend (Jenny Drenth Coleman) if you want to go check out the updates. Someone wrote this on my facebook page and I thought it was so awesome: "Glad prayers are like Facebook... God gets them as soon as we hit the 'share' button! Imagine the 'in box' up there today... I think it will be full on Kerri's behalf!" So, keep 'em coming!
Thanks, Jenny
P.S. On a side note, if you don't believe that H1N1 is real or that you don't need to be concerned about it, I urge you to think again. In the ICU where Kerri is, all but 2 patients have H1N1. The majority of these patients are young women. The medical staff has been beside themselves trying to tackle this virus that is affecting so many people.

Kerri - prayer please!!

Please please please continue to pray for Kerri. She is fighting for her life and needs our prayers. Kerri fully believes in the power of prayer! She IS a fighter. Her prognosis is not good and is now in septic shock. They did something experimental and she was slowly, little by little, looking like she would improve but then got the septic shock diagnosis. I've been close friends with Kerri for 25 years. We cannot lose her!

Concert

The Miley Cyrus concert was great. I'll fill y'all in when I can type
it all out from my computer instead of phone. Shelby and I had a lot
of fun. I have to say Miley is going through the transformation like
Britney Spears did at this age. Lots of non Disney style dancing.
Definitly NOT a Hannah Montana show. But overall it was awesome.

Cake for Tucker?

Yesterday I was surfing the net trying to find an idea for a bday cake for Tucker. I had gone to the bakery but didn't see anything that I liked, but Jenny (the cake maker) told me to see if I can find something online that I like, and she would do something similar. Tucker saw me searching through photos and he went crazy over this one and literally stared at it for 30 minutes. So I sent Jenny this photo this morning and hopefully she says yes she's able to make it. I have all the pieces to go on top that she can use. Fingers crossed she says yes. I was going to try and do cupcakes this year, but I just don't have time to get it done the Friday night before the party. I plan to be at the pavillion painting a figure 8 race track on the slab with some washable paint. ***update*** Just heard from Jenny and she can make the cake. Yay!

halloween treats

Tucker's class will be having a halloween party so I found these super cute halloween snow globes at walgreens and the halloween themed takeout boxes.

app on my phone

So I have this way cool app on my iphone that I downloaded. It's called red laser. What I do is open up the app and my little camera screen pops up. I wave it in front of a bar code of an item and up pops the price and the prices of competitors!!! Example, I scanned chixos design a luxury loft barcode at target. Price came up for $26.97. Then under that came the price that amazon, walmart, and destination toys have it listed for. So then I can go back say a week or so later and hit refresh on that item on my phone and it'll tell me the most updated price. This is going to be super cool for when I'm price checking toys for xmas!!!

No more binky

It is now safe to say that Tucker is officially binky free. I'll admit that it's my fault that he's had it this long. It's not b/c I'm lazy and didn't want to deal with it. It's b/c to me he's a baby and babies have binkies. At least mine do. ;-) He hasn't had a binky at school or at my mom's house in months. So finally I just quitely got rid of them last week. I would distract him when he'd ask for it and that was about it. It was quite easy, unlike when we made Shelby quit the binky. Earlier this week I was at the gym and Lonnie put him to bed. Somewhere Lonnie found him a binky and gave it to him, not knowing that Tucker wasn't getting them anymore. I was scared this would backfire but it didn't. After he fell asleep Lonnie took the binky and he hasn't asked for it since. So I did it. I took the binky away before he turned 3.

Tucker on the computer

Tucker has become a pro at the computer, just like Shelby did at 2!

Bright vs. Gifted

So I'm surfing the net today on Shelby's school website and they've posted some info about the gifted and talented program. Most of you know how super smart Shelby is, but after reading this and a few other things they have listed on the website, I do not think Shelby will be in the GT program. The first thing it says is that they student is at a grade level of 2 grades higher than their age. That would mean Shelby needs to be at a second grade level. I do believe she is at that level in some things, but not all. Emotionally she is still a 5 year old, but it doesn't ask that. LOL Recently they've had Shelby testing in the AR program

Check out these dogs!

These dogs belong to my friend Lee. While looking through her picasa photos I came across these 2 of her dog! I laughed outloud so hard! One dog digging in the grocery sack looking for something good while the other is watching out for him.

Soccer Game

Shelby's back in soccer this season with the YMCA. You would think with as much as we pay for soccer with them that they could AT LEAST get their act together when it comes time for team photos. This is the second time in a row now that Shelby has not had a team photo. First time was due to mass chaos and disorganization. This time was due to nobody knowing who their team members were and the team not even being listed on the roster to have their photos taken. Grrr! Whatever. So they had a game in Pasadena this weekend and won. YAY! Emilie went to the game with us and kept Tucker busy and entertained for most of the game. He spent the other bit flirting with some older girls.

This is Tucker getting hyped up on Lonnie's Dr. Pepper.

This is Emilie showing off her skills. Shelby enjoyed Emilie chanting her cheers from the sidelines.
This is Tucker trying to imitate Emilie. Hahahahaha!
Do you like Shelby's hairbow? I made it. ;-)
